Palace Modern Hotel (“Hotel”) is an independently owned boutique hotel committed to providing our Guests with a comfortable, private, and seamless stay. These Reservation Terms & Guest Policies (“Terms”) are intended to clearly communicate our reservation policies, our contactless service model, and the responsibilities of the Hotel and our Guests.
BY COMPLETING A RESERVATION WITH PALACE MODERN HOTEL, THE PERSON MAKING THE RESERVATION (“GUEST”) ACKNOWLEDGES AND AGREES TO THESE TERMS AND ACCEPTS RESPONSIBILITY FOR COMMUNICATING APPLICABLE HOTEL POLICIES TO ALL MEMBERS OF THEIR PARTY AND VISITORS.
Cancellation Policy
We understand that plans change. Because Palace Modern is a small, independently owned hotel with limited room inventory, late cancellations have a significant impact on our ability to rebook accommodations.
Reservations cancelled at least five (5) days before the scheduled check-in date are eligible for a full refund. Cancellations received fewer than five (5) days before the scheduled check-in date are non-refundable. If your plans change, you may transfer your reservation to a friend or family member by contacting the Hotel before arrival. The person assuming the reservation must meet the Hotel’s reservation and Guest requirements.
Certain promotional, discounted, group, event, or third-party reservations may have different cancellation or refund terms. When different terms are disclosed at the time of booking, those terms will apply.
Our Contactless Service Model
Palace Modern operates under a tech-enabled, contactless hospitality model designed to provide Guests with privacy, flexibility, and a seamless experience.
Our service model includes:
- Keyless room access
- Digital arrival instructions
- A self-service Amenities Room with Guest essentials
- Guest support through digital communication (text, phone, or email)
- An electronic parking pass for in-and-out access to the hotel’s designated parking garage
Palace Modern does not maintain a traditional staffed, on-site front desk, concierge, or bell staff. Guests may contact the Hotel team for assistance throughout their stay via email, text, or phone, and the Guest making the reservation agrees to communicate this service model to all Guests in their party prior to arrival. For reservations involving multiple rooms or Guests, the primary Guest may be responsible for receiving and providing authorized members of their party with the access information necessary for their assigned accommodations. Access codes and other security credentials should not be shared with anyone who is not an authorized Guest.
Guests requiring assistance or a reasonable accommodation related to a disability may contact the Hotel before arrival or at any time during their stay. The Hotel will provide reasonable modifications, auxiliary aids, and alternative methods of communication as required by applicable law.
Check-In & Check-Out
Check-In: 3:00 PM
Check-Out: 11:00 AM
For check-in, the access code provided to the Guest in advance of their arrival via electronic communications, becomes active to allow the Guest entry into the property. Likewise, that code expires at check-out time on the day of departure. Early arrival and late departure requests are subject to availability and advance Hotel approval. It is not required that Guests notify the hotel upon check-in and check-out, but it is appreciated.
Upon check out, Guests are asked to lock their guest room behind them and to leave the parking pass provided either in the guest room, or in the drop box located just outside the hotel entry door.
Guest Policies
Conduct deemed disorderly, at the sole discretion of Hotel management, shall be grounds for immediate expulsion from the Hotel and termination of stay. In such cases, no refund of the rental fee shall be made. The person making the reservation is considered the primary Guest and is responsible for the reservation, for compliance with these Terms by occupants and Visitors associated with the reservation, and for damage or additional charges resulting from their actions.
Only registered or otherwise authorized Guests may stay overnight. Guest rooms may not exceed approved occupancy limits which are stated during the booking process. All Guests must follow Hotel policies, including:
1. Guest Conduct & Quiet Hours
We ask all Guests to respect the Hotel, our neighbors, other Guests, and the peaceful environment of the property.
Quiet hours are observed from 10:00 PM to 8:00 AM. Excessive noise, unauthorized parties, disruptive behavior, harassment, threats, illegal activity, or conduct that materially interferes with the safety, comfort, or quiet enjoyment of other Guests or Hotel operations is not permitted.
2. Smoking & Vaping
Smoking and vaping are prohibited on the hotel property. Guests may be responsible for reasonable cleaning, deodorizing, remediation, or other costs resulting from a violation of this policy.
3. Pets & Service Animals
Pets are not permitted. Service animals are welcome in accordance with applicable law and must remain under the control of their handler. Service animals may not be left unattended in Guest rooms. The Hotel does not impose a pet fee or special cleaning fee for a service animal. Guests may, however, be responsible for damage caused by a service animal to the same extent that Guests are responsible for other damage they cause.
4. Parking
Complimentary parking is included with your stay by using Hotel-issued parking credentials as directed. Hotel parking passes must be returned at departure by leaving them in the guest room or by using the drop box located outside the hotel entrance. Lost or unreturned parking passes will result in a replacement fee.
5. Prohibited Activity & Items
Illegal substances and illegal activity are prohibited on Hotel property. Firearms and other weapons are prohibited on Hotel property except as otherwise required or permitted by applicable law.
Housekeeping & Room Care
Daily housekeeping is not included as part of the room rate. For stays of four (4) consecutive nights or longer, one complimentary mid-stay room refresh is included – requesting and scheduling this cleaning through our Hotel Host should be done in advance. Additional housekeeping services may be arranged for a fee, subject to availability, and should be requested in advance. Palace Modern contains carefully selected artwork, furnishings, linens, and other property. Guests are expected to treat Guest rooms, artwork, furnishings, linens, and shared Hotel spaces with reasonable care.
Payment & Additional Charges
Guest authorizes the Hotel to charge the payment method provided for the reservation for room charges, applicable taxes, disclosed fees, and other amounts authorized in connection with the reservation. Guest is also responsible for reasonable costs resulting from damage to Hotel property, missing Hotel property, smoking or vaping remediation, excessive cleaning beyond that reasonably required following an ordinary stay, lost or unreturned Hotel property or parking credentials, and other charges resulting from a material violation of these Terms.
To the extent permitted by applicable law and the applicable payment-card agreement, Guest authorizes the Hotel to charge the payment method on file for such amounts following the stay. The Hotel will maintain reasonable documentation supporting material post-stay charges and will provide information regarding such charges upon reasonable request.
Third-Party Booking Communications & Guest Access
Palace Modern operates as a contactless hotel. Timely receipt of arrival instructions, including building and Guest room access codes, is essential to a seamless check-in experience.
Guests who reserve accommodations through an online travel agency (OTA) or other third-party booking platform acknowledge that communications between the Hotel and Guest may be transmitted through systems outside the Hotel's control. These platforms may delay, filter, restrict, block, or otherwise interfere with the delivery of Hotel communications, including essential arrival and access instructions.
Guests are responsible for providing accurate contact information. If arrival instructions or access codes have not been received at least 24 hours before the scheduled check-in time, Guests must contact Palace Modern directly by telephone, text, or email to obtain assistance. Guests experiencing difficulty accessing the property upon arrival must contact the Hotel directly and provide a reasonable opportunity for the Hotel to resolve the issue before securing alternative accommodations.
To the fullest extent permitted by applicable law, the Hotel shall not be financially responsible for communication failures attributable to an OTA, third-party booking platform, telecommunications provider, or other independent service provider, provided the Hotel has made reasonable efforts to communicate the necessary information and remains reasonably available to assist the Guest.
When a Guest fails to receive arrival instructions due to circumstances outside the Hotel's reasonable control and elects to secure alternative accommodations without first contacting the Hotel directly and allowing a reasonable opportunity to resolve the access issue, the Hotel shall not be responsible for the cost of alternative lodging, transportation, or other consequential expenses arising from that decision, except as required by applicable law.
Such circumstances do not automatically entitle the Guest to a refund or cancellation without penalty when the reserved accommodation was available and the Hotel was ready and reasonably able to provide access.
Personal Belongings & Lost Property
Guests are responsible for appropriately securing their personal belongings. To the fullest extent permitted by applicable law, the Hotel is not responsible for the loss, theft, or damage of personal belongings except where responsibility cannot lawfully be excluded or limited. The Hotel will make reasonable efforts to identify and return property recovered after a Guest’s departure. Guests may be responsible for reasonable shipping or delivery expenses associated with returning recovered property.
Events Beyond the Hotel’s Control
The Hotel will not be responsible for a failure or delay in providing accommodations, communication reservation or check-in instructions, or services when caused by circumstances beyond its reasonable control, including natural disasters, wildfire, severe weather, fire, utility or infrastructure failures, government orders, civil emergencies, or similar events. If such an event prevents the Hotel from providing the reserved accommodation, the Hotel will work in good faith with the Guest to determine an appropriate resolution, which may include alternative accommodations when reasonably available, rescheduling, a reservation credit, or a refund, depending upon the circumstances and applicable law.
A Guest’s inability to travel to the Hotel, including because of transportation delays or cancellations, does not by itself constitute an inability of the Hotel to provide the reserved accommodation and remains subject to the applicable cancellation policy unless otherwise required by law.
Guest Indemnification.
Guest agrees to indemnify, defend, and hold the hotel, its owners and its employees, contractors and contracted vendors harmless of and from any liabilities, costs, penalties, or expenses arising out of and/or resulting from the Hotel stay. In the event the hotel Owner or its employees, contractors and contracted vendors are required to file any action in court to enforce any provisions of this Contract, Guest agrees to pay all reasonable attorney fees, court fees, and costs of suit incurred, including all collection expenses and interest due should Hotel Owner or the identified parties prevail in such action.
Enforcement & Collection Costs
If amounts properly owed under these Terms remain unpaid and the Hotel is required to pursue collection or legal enforcement, the Hotel may seek reasonable collection costs, court costs, and attorneys’ fees to the extent authorized by applicable law or awarded by a court. Nothing in these Terms limits any rights or remedies available to either the Hotel or Guest under applicable law.
Governing Law & Severability
These Terms and reservations with Palace Modern Hotel are governed by applicable federal law and the laws of the State of New Mexico. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
